I really empathise with you but… that's Japan!
Unfortunately, hypocrisy in the law is the practical consequence of legislative government, especially in a nation with powerful divisions in the population. Japan is worse than some, but that's because of the unique interplay of and conflict between (mostly Rawlsian liberal) Western and (mostly nostalgic fascist) phaux-historical influences.
In this particular case, it doesn't help that pornography laws are so low on the list for most of Japan's defenders of civil rights. They're somewhat more preoccupied with the Net Right's attacks on anyone who tries to acknowledge the country's wartime history, or with the fact that teachers can be fired for refusing to stand at the national anthem on the grounds that they find it imperialist and anti-democratic.
At least the local CP is gaining ground. Who knows, maybe Japanese communists are really enthusiastic about pornography?
